NO FCRA USE. New Mexico Criminal History is privately owned and has no affiliation with a federal, state, or local government body. This site and its advertising partners do not offer services for credit, employment, insurance, tenant, or other decisions regulated by the Fair Credit Reporting Act (FCRA). We provide reference information about New Mexico record sources. We are neither a private investigation firm nor a consumer reporting agency.
1. What This Website Is
This is a private reference site operated independently of government. We do not store official records, conduct government criminal-history checks, retrieve records, or submit documents on a visitor's behalf.
Our content identifies New Mexico sources such as the New Mexico DPS Law Enforcement Records Bureau, New Mexico Corrections Department, New Mexico DPS Sex Offender Registry, state courts, and offices in the state's 33 counties. Some pages also connect visitors with outside research tools. The New Mexico Inspection of Public Records Act, §§14-2-1 through 14-2-12 NMSA 1978, governs public-body records. Criminal-history dissemination is separately controlled by §§29-10-1 through 29-10-8 NMSA 1978.
2. Rules for Using This Site
By using the site, you agree not to:
- Use bots, scrapers, or other automated tools against the pages
- Attempt unauthorized access to any system or account
- Use site information to stalk, threaten, or harass a person
- Interfere with performance or prevent another visitor's access
- Rely on site content for housing, hiring, lending, or insurance decisions
- Violate federal, New Mexico, or local law while using the site
3. No Harassment, Stalking, or Discrimination
You may not use content from this site or a linked tool to stalk, harass, intimidate, threaten, or discriminate against anyone. Such conduct may also be criminal. This restriction is especially important for the New Mexico DPS Sex Offender Registry. Registry information supports public safety awareness, not vigilantism, employment blacklisting, housing discrimination, or action against a listed person.
4. We Are Not a Consumer Reporting Agency
We are not a consumer reporting agency under the FCRA and do not create credit reports, background checks, or consumer reports. Our advertising partners do not provide site tools designed to review applicants, renters, creditworthiness, or insurance risk. You must not use information from this site or a linked tool to:
- Set insurance premiums or assess creditworthiness
- Evaluate a prospective renter or housing applicant
- Make hiring or termination decisions
- Decide eligibility for a license, permit, or government benefit
- Carry out any other activity governed by the FCRA
A lawful check for an FCRA-regulated purpose must come from an appropriate FCRA-compliant provider or the official channel required for that purpose, not from this site.
5. No Legal Advice
The content is not legal advice. It offers general information about New Mexico records, but it cannot determine how a charge, warrant, conviction, or expungement rule affects a particular matter. Consult a lawyer licensed in New Mexico for legal advice.
6. No Warranties
All content is provided "as is." We make no promise that:
- Partner search results will be accurate or complete
- The site will remain available without interruption
- Site information will always be complete, accurate, or current
- The pages will contain no error, defect, or security weakness
Criminal records can change as charges are filed, dismissed, expunged, or sealed. Information may therefore lag behind an official source. Do not treat any site content as a statement from New Mexico DPS, a court, a sheriff, or another government agency.
7. Third-Party Services and Links
Links may lead to New Mexico agencies, court portals, county offices, legal-aid groups, or outside search providers. We do not control a destination's content, fees, availability, or data practices and accept no responsibility for them. Review the destination's terms before use.
8. Intellectual Property
Text, graphics, logos, and code belong to New Mexico Criminal History or its content partners. You may not copy, modify, distribute, or create derivative works from that material without prior written permission.
9. Limits on Our Liability
To the maximum extent permitted by law, we are not liable for damages arising from site use, including action taken in reliance on this content or a linked service.
10. Indemnification
You agree to hold us harmless against claims, actions, or demands arising from your site use or violation of these terms, including related costs and legal fees.
11. Governing Law
New Mexico law governs these terms. A legal dispute arising from use of the site must be brought in a court located in New Mexico.
12. Changes to These Terms
We may revise these terms at any time. A revised version becomes effective when posted on this page.
13. Cutting Off Access
We may suspend, restrict, or end access at any time, for any reason, without advance notice.
14. Severability
If a court finds one provision invalid or unenforceable, all remaining provisions continue in effect. The affected language will be changed only as much as necessary to make it enforceable.
15. Questions
Questions about these conditions may be directed through the Contact page.
